The tender for the works shall remain open for acceptance for a period of sixty (60) days from the date of opening of tenders. If any lowest tenderer revoking his offer / tender or revising his rates upward (which will be treated as revocation of offer), before the said period or issue of letter of acceptance, whichever is earlier, or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Government shall, without prejudice to any other right or remedy, be at liberty to forfeit the said earnest money as aforesaid. In case of MES enlisted contractors, the amount equal to the Earnest Money stipulated in the Notice of Tender, shall be notified to the tenderer for depositing the amount through MRO, failing which the amount shall be recovered from payment due to such Contractor or shall be adjusted from his Standing Security Deposit. Participation for further tender to such tenderer (s) shall also remain suspended till the aforesaid Earnest money is deposited in the Govt Treasury. Further the tenderer shall not be allowed to participate in the retendering process of the work.
