#### **2. ELIGIBILITY CRITERIA**
* **For MES Enlisted Contractors:**
* Must be enlisted in **Class ‘C’** and **Category ‘d(v)’**.
* Must have satisfactory performance remarks in Work Load Return (WLR).
* **For Un-enlisted Contractors:**
* Must meet the enlistment criteria for Class ‘C’, Category ‘d(v)’ MES contractors.
* Must have satisfactorily completed works of similar nature and value.
* Must provide proof of:
* Annual turnover, bank solvency, working capital.
* Immovable property/fixed assets, T&P, engineering establishment.
* No outstanding recoveries in any Govt. department.
* Police verification/valid passport for proprietor/partners/directors.
* **Not suspended/debarred/blacklisted** by any Central/State Govt./PSU.
* Foreign firms **not eligible**. Indian firms with foreign directors require security clearance.
* Un-enlisted contractors already executing MES works **must not exceed twice** the tendering limit of their eligible class.

#### **4. IMPORTANT CONDITIONS & CLAUSES**
* **Single Bid per Firm:** Only one bid allowed per contractor/firm.
* **Anti-Collusion:** Father-son/close relatives/firms with common partners **cannot bid separately**. Breach leads to rejection of both bids.
* **Site & Document Inspection:**
* Bidders advised to inspect site & samples at GE/AGE(I) office by prior appointment.
* Submission implies full knowledge of site, documents, and conditions.
* **Alterations to Conditions:** Any bid proposing changes to conditions is liable for rejection.
* **Acceptance of Tender:** Accepting Officer **not bound** to accept lowest or any bid. No reasons required for rejection.
* **Price Preference:** Preference may be given to Public Undertakings/SMEs as per Govt. policy, even if their bid is not lowest.
* **Subletting:** Work **cannot be sublet** or executed via attorney to third parties. Can be executed through POA to family members/firm employees if they do not have a separate enlisted firm.

#### **5. DOCUMENT REQUIREMENTS**
* **Enlisted Contractors (Cover-1):**
* Application on letterhead.
* Valid enlistment letter.
* Scanned DD for tender cost & EMD (if SSD bond not signed).
* **Un-enlisted Contractors (Cover-1):**
* Application on letterhead.
* Scanned DD for tender cost & EMD.
* Police Verification/Passport copies.
* All documents per MES Manual on Contracts 2020 for enlistment.
* Details of ongoing MES works (if any).

#### **6. POST-SUBMISSION PROCESS**
* **Physical Document Submission:** Original DDs/EMD instruments must reach Accepting Officer **within 7 days** of bid submission end date. Failure leads to:
* **Enlisted:** Financial bid opened but firm banned for 6 months.
* **Un-enlisted:** Financial bid **not opened** & firm barred for 6 months.
* **Deficiency Rectification:** If deficiencies found in Cover-1, contractor given **7 days** to rectify via email/SMS. Failure → Financial bid not opened.
* **Technical Bid Validation:** Accepting Officer can reject any technical bid. Rejected bidders can appeal to NHEA (HQ Chief Engineer (AF) Prayagraj Zone) before Cover-2 opening.
