**2. Eligibility Criteria (Critical for Bidders)**

– **For MES Enlisted Contractors:**
– Must be enlisted in Class ‘B’ and above in category ‘b(ii)’.
– Must have satisfactory performance remarks in their Work Load Return (WLR).
– *Alternative:* Class ‘B’ and above with a tie-up (MoU) with a solar power firm rated by agencies like CRISIL/CARE/ICRA, etc.
– **For Contractors NOT Enlisted with MES:**
– Must meet the criteria for MES ‘B’ Class, ‘b(ii)’ category enlistment. This includes:
– Satisfactorily completed works of requisite value with government/PSUs.
– Meeting requirements for annual turnover, bank solvency, and working capital (as per MES Manual of Contracts 2020, Para 1.4 & 1.5).
– Must not be suspended, debarred, or blacklisted by any government body.
– Must provide details of completed and ongoing works in a specified format.
– **Foreign firms are not eligible.** Indian firms with foreign directors are subject to security clearance.
**3. Relaxation for Lower-Class Contractors**
– If after the first round of evaluation, fewer than 7 eligible bidders are found, contractors from **one class below** (or two classes below for remote areas) the required class will also be considered.
– However, these lower-class contractors are only eligible if either:
– Their residual work is **not** more than five times their tendering limit, OR
– They meet the criteria for upgrading to the required class (based on past experience and financial soundness).
**4. Tender Fee and Earnest Money Deposit (EMD)**
– **Cost of Tender Documents:** ₹1000/- via DD or Banker’s Cheque in favor of GE Panagarh. (Exempted for those who bid in a previous cancelled call for this same work).
– **EMD:** Required for unenlisted contractors and enlisted contractors who haven’t signed a Standing Security Bond. The amount is specified in Appendix ‘A’. It can be a Deposit at Call receipt or a Treasury Challan.

– **For both:** If the physical EMD is not received, the Financial Bid will **not** be opened.
**5. Bid Submission and Opening Process**
– **Portal:** Bids must be uploaded on www.defproc.gov.in.
– **Two-Bid System:**
– **Cover 1 (Technical Bid):** Contains scanned copies of the tender fee DD, EMD (if applicable), enlistment documents, application form, and other eligibility documents (like police clearance for unenlisted firms).
– **Cover 2 (Financial Bid):** Contains the priced BOQ. This is only opened if the Technical Bid is deemed valid.
– **Deficiency Rectification:** If documents are missing or deficient in Cover 1, the bidder gets a **7-day window** from the date of communication to rectify the issue. Failure to do so results in the Financial Bid not being opened.
**6. Key Rules and Restrictions for Bidders**
– **Single Bid:** Only one tender per firm is allowed.
– **Related Firms:** Bidders with common Proprietors/Partners/Directors are considered “related” and cannot bid for the same contract. Both bids are liable for rejection.
– **No Subletting:** The work cannot be sublet to a third party. Power of Attorney can only be given to immediate family members or firm employees/directors, provided they don’t own a separate enlisted firm.
– **No Alterations:** Any tender proposing alterations to the conditions or adding new conditions is liable for rejection.
– **BOQ Revisions:** If the BOQ is revised via a corrigendum and a bidder quotes on the old BOQ, their bid is considered “non-bonafide” and will be rejected.
– **Withdrawing/Revising Offer:** If the lowest bidder tries to withdraw or revise their price upward after the bid closing date, it is a “willful default.” Their EMD will be forfeited, and they will be suspended from future tenders. The contract will then be re-tendered.
