## 🧾 **Eligibility Criteria**
### **(A) MES-Enlisted Contractors**
* Class **‘C’ and above**, with satisfactory performance records.
* Must have an **MoU with a solar power firm** rated **1A/1B/1C/2A/2B/2C** by recognized agencies such as **CRISIL, CARE, ICRA, SMERA, Brickwork, or Fitch**.
* Enlisted contractors with the same solar rating may also qualify without MoU.

### **(B) Un-Enlisted Contractors**
* Must fulfill the **enlistment criteria equivalent to Class ‘C’** (refer Para 1.4 & 1.5, Section 1, MES Manual on Contracts 2020).
* Must have a **valid MoU with solar power firm** rated **1A/1B/1C** or have an equivalent in-house rating.
* Should not be:
* Blacklisted/suspended by any government/PSU/defence organization.
* Carrying adverse remarks in workload reports.
* Must provide details of **works completed or in progress** in the MES format.

### **(C) Technical Experience (All Contractors)**
* Must have **commissioned solar plants** for Government Departments/PSUs in the last 7 years:
* One project ≥ **88 kW**, or
* Two projects ≥ **55 kW**, or
* Three projects ≥ **44 kW**.
* If un-enlisted but awarded ≥2 works in MES, registration in MES Class ‘C’ is mandatory.

### **(D) Notes on MoUs**
* One eligible solar firm can have **only one MoU per tender**.
* If a firm appears in multiple bids, all such bids become **invalid/non-bonafide**.
* **Exclusive bidder-firm pairing** is mandatory.

## 🧮 **Bidding Rules & Process**
1. **Single Bid Rule:**
No individual, firm, or related entities (father/son/partners/directors in common) can bid separately.
2. **Bid Submission:**
* Technical Bid (Cover-1): Includes DDs, eligibility docs, MoUs, and forms.
* Financial Bid (Cover-2): BOQ/quoted rates.
* Physical DDs for cost/EMD must reach within **5 days** of bid closure.
3. **Disqualification Triggers:**
* Failure to submit original EMD within 5 days.
* Missing or deficient documents after 7-day rectification period.
* Uploading bids on **pre-revised BOQs** after corrigendum.
* Revoking offer or revising rates post-opening (penalty = EMD forfeiture).
4. **Foreign Participation:**
* **Foreign firms** not eligible.
* Indian firms with **foreign directors** must obtain **security clearance**.
5. **Subletting Restrictions:**
* Subletting or Power of Attorney to third parties prohibited.
* Allowed only for **family members or in-house employees**.

## 🧾 **Important Administrative Provisions**
### **Validation & Evaluation**
* Only technically validated bids proceed to financial opening.
* **Minimum 7 qualified bidders** required; if fewer, one-class-below bidders may be considered if financially sound.
### **Performance & Security**
* Successful bidder must provide **Performance Security** as per Condition 19 of IAFW-2249.
* EMD may be converted into part of this security within 28 days of LoA.
### **Integrity Pact**
* Mandatory document forming part of the contract.
* Must be signed and uploaded with Technical Bid; otherwise, bid rejection.
