### **3. ELIGIBILITY CRITERIA**
– **For MES Enlisted Contractors:**
– Must be enlisted in **Class ‘E’ or above**.
– Must have an **MoU with a solar power firm** rated 1A/1B/1C/2A/2B/2C by CRISIL/CARE/FITCH/ICRA/SMERA/Brick Work Ratings.
– Experience requirements as specified.
– **For Non-Enlisted Contractors:**
– Must meet the **financial and technical criteria equivalent to Class ‘E’ or above** (annual turnover, solvency, working capital, experience).
– Must also have an **MoU with a rated solar firm** (unless the contractor itself holds the requisite rating).
– Must not be suspended/debarred/blacklisted by any government body.
– Must submit detailed past work experience with Central/State Govt., PSUs, etc.
– **General Conditions:**
– **Foreign firms are not eligible.** Indian firms with foreign directors require security clearance.
– **Related firms** (common proprietors/partners/directors) cannot bid for the same contract.

### **4. BID SUBMISSION PROCESS**
– **Two-Envelope System:** Cover-1 (Technical Bid) and Cover-2 (Financial Bid).
– **Cover-1 Must Include:**
– Scanned copy of DD for tender cost and EMD (if applicable).
– Required eligibility documents (enlistment certificate, MoU, GST/EPFO registration, police clearance, etc.).

– **Financial Bid Opening (Cover-2):**

### **6. KEY CONTRACTUAL CONDITIONS**
– **No Subletting:** Work cannot be sublet or executed via a third party under Power of Attorney, except to family members or firm employees who are not separately enlisted in MES.
– **Site Inspection:** Bidders are advised to inspect the site and materials before bidding.
– **Governing Law:** Jurisdiction lies with **courts in Jaisalmer/Jodhpur, Rajasthan**.

### **7. PENALTIES & DEFAULT CLAUSES**

– **Unenlisted contractors:** EMD forfeited.
– **Enlisted contractors:** Required to deposit an amount equal to EMD via MRO; barred from future tenders until paid.
– **Non-Submission of Performance Security:** May lead to **suspension from bidding for 6 months** (unenlisted) or until EMD is deposited (enlisted).
– **Non-Compliance with BOQ Revisions:** Bids based on outdated BOQs may be treated as **non-bonafide**.
