**2. Tender Process & Documentation**
* **Type:** E-tender, based on IAFW-1779-A (Revised-1955) with Schedule “A” (BOQ) and IAFW-2249 General Conditions of Contracts.
* **Bid Structure:**
* **Cover-1 (Technical Bid/’T’ bid):** Contains eligibility documents, enlistment details, and scanned copies of the DD for tender cost and EMD.
* **Cover-2 (Financial Bid/’Q’ bid):** Contains the priced Bill of Quantities (BOQ).
* **Key Documents:** Available for download on www.defproc.gov.in and www.mes.gov.in.
* **Cost of Tender Documents:** ₹500/- via DD/Banker’s Cheque in favour of “GE (AF) No 2 Jodhpur”. *Note: Contractors who quoted in a previous call for this same work are exempt from this cost.*

**3. Financial Security Requirements**
* **Earnest Money Deposit (EMD):** ₹76,000/-. Must be in the form of a **Deposit at Call Receipt** in favour of GE (AF) No 2 Jodhpur. **FDRs are not acceptable.**
* *Exemption:* Contractors who have deposited a Standing Security Bond with MES are exempt from submitting EMD.
* **Performance Security Deposit:**
* **Amount:** 5% of the total contract sum.
* **Timeline:** Must be lodged within 28 days of receiving the tender acceptance notification.
* **Consequence of Non-compliance:** Failure to provide this deposit will lead to cancellation of the work award and forfeiture of EMD (if applicable).

**4. Eligibility Criteria**
* **For MES Enlisted Contractors:**
* Must be enlisted with MES in **Class D or above**.
* Must have a Memorandum of Understanding (MoU) with a rated solar power firm (CRISIL/CARE/etc. rating 1A to 2C) that has the requisite experience. Contractors with their own solar rating are also eligible.
* Must have no adverse remarks in their Work Load Return (WLR).
* **For Contractors Not Enlisted with MES:**
* Must meet all enlistment criteria for MES Class D (as per MES Manual of Contracts 2020), including financial stability, turnover, and solvency.
* Must not be suspended/debarred/blacklisted by any government entity.
* Must have an MoU with a rated solar power firm (as above) or possess the rating themselves.
* **If they have already secured two MES works, they must get enlisted to be eligible for future tenders.**

**5. Technical Eligibility (Solar Power Experience)**
The bidding contractor (or their MoU partner) must have experience in successfully completing and commissioning solar power plants for Government/PSUs in the last seven years, meeting one of the following criteria:
* One work of at least 80% capacity (i.e., **32 KW**).
* Two works of at least 50% capacity (i.e., **20 KW each**).
* Three works of at least 40% capacity (i.e., **16 KW each**).

**6. Important Clauses & Bidder Restrictions**
* **MoU Rules:** A solar power firm can either bid directly or partner with one contractor via an MoU, but not both simultaneously for the same tender.
* **Single Bid per Entity:** Only one bid per contractor/firm is allowed. Close relatives with business dealings cannot bid against each other for the same contract.
* **No Subletting:** Subletting the work is strictly prohibited. Execution can only be done by the firm or through Power of Attorney to immediate family/senior employees, provided they are not proprietors/partners of another MES-enlisted firm.
* **Site Inspection:** Bidders are advised to inspect the site. By bidding, they are deemed to have full knowledge of all site conditions and documents, regardless of inspection.
* **No Bid Alterations:** Any bid proposing alterations to the laid-down conditions is liable for rejection.

**7. Evaluation and Rejection Rights**
* **Technical Bid Validation:** The Accepting Officer (CWE (AF) JODHPUR) has the sole right to validate ‘T’ bids and may reject a bid without opening the financial proposal, based on the firm’s capability.
* **Appeal Process:** If a ‘T’ bid is rejected, the bidder can appeal to the Next Higher Engineer Authority (HQ CE (AF) Gandhinagar) within 7 days. Their decision is final.
* **Right to Reject:** The Accepting Officer is not bound to accept the lowest or any bid and reserves the right to give price preference to Public Sector Undertakings (PSUs).
