**2. Tender Process & Key Dates**
– **Mode:** Online e-tendering via the defence procurement portal (www.defproc.gov.in).
– **Cost of Tender Documents:** Rs. 1,000/- (payable via DD/Banker’s Cheque).
– **Earnest Money Deposit (EMD):** Rs. 1,18,000/- (to be submitted with the bid).
– **Critical Dates:** The specific start and end dates for bid submission and the bid opening date are to be found on the procurement portal.

**3. Eligibility Criteria (Complex)**
The eligibility is structured into three categories, with a strong emphasis on experience in solar power projects and partnering with MNRE-approved channel partners.

– **For MES Enlisted Contractors:**
– Must be enlisted in **Class ‘C’** .
– Must have a **Memorandum of Understanding (MoU)** with an MNRE-approved channel partner (rating 1A, 1B, 1C, 2A, 2B, or 2C) who holds the required solar experience.
– Alternatively, if the contractor themselves is an MNRE-approved channel partner meeting the criteria, they are also eligible.

– **For Unenlisted Contractors:**
– Must meet the MES Class ‘C’ enlistment criteria regarding financials (turnover, solvency) and past work experience with government bodies.
– Must also have an **MoU with an MNRE-approved channel partner** meeting the experience criteria.
– Must not be blacklisted or suspended by any government department.

– **Mandatory Experience Requirement (for the MNRE Partner or Direct Bidder):**
– The entity providing the solar expertise must have successfully completed comprehensive repair/maintenance or new works of solar power plants for a government department/PSU in the last seven years. The work must be:
– One work of capacity **not less than 4.8MW**, OR
– Two works of capacity **not less than 3MW** each, OR
– Three works of capacity **not less than 2.4MW** each.

– **Rules for Contractors Below Eligible Class:**
– If fewer than 7 eligible bidders apply, the authority may consider MES contractors one or two classes below Class ‘C’. This is subject to their residual work in hand not exceeding five times their tendering limit, or they must qualify for “upgradation” based on superior past performance and financials.

**4. Key Contractual & Compliance Conditions**
– **No Subletting:** The work cannot be sublet to a third party. Execution can only be done through the firm’s own employees or specified relatives (sons/daughters/spouse of proprietor/partners/directors).
– **MNRE Partner Exclusivity:** An MNRE-approved channel partner can either bid directly or enter into an MoU with a contractor for this tender, but **cannot do both**. Violation will invalidate the direct bid.
– **Document Submission:** Bidders must upload all required documents (enlistment letters, MoU, experience certificates, etc.) in “Cover-1” (Technical Bid). Failure to submit physical copies of the tender fee and EMD within 7 days of the bid end date can lead to penalties, including being banned from bidding for six months.
– **Deficiency Rectification:** If a bidder’s technical submission is deficient, they will be given **7 days** to rectify it.
– **Revocation of Offer:** If the lowest bidder tries to revoke their offer or revise rates upwards after bid submission, their EMD will be forfeited, and the tender may be retendered instead of awarding to the next lowest bidder.

**5. Compliance and Legal Framework**
– **Technical Validation:** The Accepting Officer has the sole right to validate or reject any technical bid. Rejected bidders can appeal to the next higher engineer authority (CEJZ, Jodhpur) within a specified timeframe.
– **Related Firms:** Tenders will not be issued simultaneously to firms with common proprietors, partners, or directors. The Accepting Officer’s decision on this is final.
– **Foreign Firms:** Foreign firms are not eligible. Indian firms with foreign nationals or non-resident Indians as directors are subject to security clearance.
