#### 3. Eligibility Criteria (Business Qualification)

Bidders fall into two main categories. **Note:** Foreign firms are not eligible.

**A. For Contractors Enlisted with MES:**
– Must be enlisted in **Class ‘B’ and above**, category ‘b(ii)’.
– Must have a satisfactory Work Load Return (WLR) report.
– Contractors of one or two classes below the eligible class (e.g., Class C/D) *may* be considered if the number of eligible Class B bidders is low (less than 7). However, their eligibility is subject to strict conditions regarding residual work-in-hand and fulfillment of upgradation criteria (past experience, financial soundness).

**B. For Contractors Not Enlisted with MES:**
– Must meet the same enlistment criteria as MES Class ‘B’, category ‘b(ii)’ contractors.
– **Key Requirements:**
– **Experience:** Satisfactory completion of works of requisite value with Central/State Government, PSUs, or other specified authorities.
– **Financial Strength:** Must meet criteria for annual turnover, bank solvency, and working capital as per MES Manual on Contracts 2020.
– **Clean Record:** Must not be suspended, debarred, or blacklisted by any government entity.
– **Documentation:** Must upload a comprehensive set of documents, including Police Verification Report, enlistment-related financial documents, and details of any ongoing MES works.

**C. Special Note for Related Firms:**
– Tenders will not be issued simultaneously to “related firms” (where Proprietors/Partners/Directors are common). The Accepting Officer has the final authority to decide which firm, if any, is issued the tender.

#### 4. Critical Special Condition

– **Solar Rating Mandate:** The contractor **must** have a Memorandum of Understanding (MoU) with a solar power firm possessing a rating of **1A/1B/1C/2A/2B/2C** from recognized agencies (CRISIL/CARE/FITCH/ICRA/SMERA/Brick Work Ratings India Pvt Ltd). The partner firm must also have the specified experience.

#### 5. Bid Submission Process & Key Rules

– **Platform:** All bids must be submitted online via the government portal **www.defproc.gov.in**.
– **Two-Cover System:**
– **Cover 1 (Technical):** Contains eligibility documents, enlistment certificates, tender cost DD, EMD instrument, etc.
– **Cover 2 (Financial):** Contains the price bid (BOQ).
– **Critical Physical Submission Rule:** While scanned copies of the tender cost and EMD are uploaded online, the **original physical instruments must reach the Accepting Officer’s office within 5 days** of the bid submission end date. Failure to do so can lead to:
– For **enlisted contractors:** Financial bid opened but a 6-month bidding ban imposed.
– For **unenlisted contractors:** Financial bid **not opened** and a 6-month bid circulation for non-opening.
– If the **EMD** physical copy is not received, the financial bid will not be opened for any contractor.
