#### 5. Bid Security (EMD) Requirements

#### 8. Land Border Restrictions (Security-Related Provisions)

– Any bidder (including Indian bidders) having a **Transfer of Technology (ToT) arrangement** with an entity from such a country must also be registered with the Competent Authority.

#### 9. NTPC’s Reserved Rights
NTPC reserves the following rights:
– To assess the capabilities and capacity of bidders, their collaborators, associates, subsidiaries, or group companies, if circumstances warrant.
– To impose **additional performance security** at its discretion to safeguard contract execution.
– To **reject any or all bids** or **cancel/withdraw the NIT** without assigning any reason, and without any claim from bidders.
