## 2. Eligibility Criteria (Key Conditions)

### A. For MES Enlisted Contractors
– Must be enlisted in **Class ‘D’ and above** with MES.
– Must have satisfactory performance with no adverse remarks in Work Load Return (WLR).
– Must have an **MOU with solar power firms** rated **1A/1B/1C/2A/2B/2C** by CRISIL/CARE/FITCH/ICRA/SMERA/Brickwork Ratings (unless the contractor itself holds such a rating).
– Must meet the experience criteria.

### B. For Contractors Not Enlisted with MES
– Must meet enlistment criteria of **Class ‘D’ & b(i) category** as per MES Manual of Contracts 2020 (similar work experience, annual turnover, bank solvency, working capital).
– Must not be suspended/debarred/blacklisted by any Central/State Government, PSU, or Autonomous Body.
– Must have MOU with rated solar power firms (or own rating as above).

### C. Relaxation for Lower Class Contractors
– If less than 7 eligible bidders, contractors **one class below** (two classes below for remote/difficult areas) may be considered.
– Such contractors will be evaluated based on residual work in hand (should not exceed 5 times tendering limit, unless they qualify for upgradation).

### D. Foreign Firms – **Not Eligible**
– Indian firms with foreign nationals or Indian-origin foreign citizens as directors may be considered subject to **security clearance**.

## 4. Critical Compliance & Penalty Provisions
