## 2. Eligibility Criteria

### A. For MES Enlisted Contractors
– Must be enlisted in **Class ‘D’ and above** with MES.
– Satisfactory performance with no adverse remarks in Work Load Return (WLR).
– Must have **MoU with MNRE-approved channel partners** having:
– **Category ‘A’ or Category ‘I’** by MNRE, **OR**
– **Credit rating 1A/1B/1C/2A/2B/2C** by CRISIL/CARE/FITCH/ICRA/SMERA/Brickwork Ratings, **OR**
– **Rating ‘A’ of MNRE**.
– Enlisted contractors with their own solar rating (meeting above criteria) are also eligible without MoU.

### B. For Contractors Not Enlisted with MES
– Must meet enlistment criteria of **Class ‘D’** as per MES Manual of Contracts 2020 (similar work experience, annual turnover, bank solvency, working capital).
– No adverse remarks in WLR (if working with MES).
– Not suspended/debarred/blacklisted by any Central/State Government, PSU, or Autonomous Body.
– Must have MoU with MNRE-approved channel partner (as above) or own solar rating.
– Foreign firms **not eligible**; Indian firms with foreign nationals/Indian-origin foreign citizens as directors may be considered subject to **security clearance**.

### C. Special Provisions for Lower Class Contractors
– If less than **7 eligible bidders** after Cover 1 opening, contractors **one class below** (two classes below for remote/difficult areas) may be considered.
– Such contractors will be evaluated based on:
– Residual work in hand (should not exceed **5 times** tendering limit, unless qualifying for upgradation)
– Upgradation criteria (past experience, turnover, financial soundness)

### D. Important Restriction on Solar Firms
– Eligible solar power firms can either:
– Bid as **direct participant/bidder**, **OR**
– Provide MoU to an MES enlisted/unenlisted contractor
– **Cannot do both simultaneously** for the same tender.
– One MoU permitted between **one solar firm** and **one contractor**.
– Violation makes all such bids **invalid**.

## 4. Performance Security (Post-Award)

## 5. Critical Compliance & Penalty Provisions
