### Key Details of the Tender

### Scope of Work

The contractor will be responsible for the execution of the pending items of work for the 500 kWp solar power plant that were not completed by the original contractor, M/s BHEL. This is a “Risk and Cost” contract, meaning the defaulting contractor (M/s BHEL) will bear the additional cost incurred in this fresh tender.

### Eligibility Criteria

The tender is open to two categories of bidders with specific requirements:

**1. For MES Enlisted Contractors:**
– Must be enlisted with MES in **Class ‘D’ and above** in category **’b(1)’** .
– Must have satisfactory performance remarks as per the Work Load Return (WLR).

**2. For Contractors NOT Enlisted with MES:**
– Must meet the enlistment criteria for a Class ‘D’, category ‘b(1)’ contractor as per the MES Manual of Contracts 2020. This includes:
– Satisfactory completion of works of requisite value for Central/State Government or PSUs.
– Minimum annual turnover requirements.
– Bank solvency and working capital as specified.
– Must not be suspended, debarred, or blacklisted by any government entity.
– Must submit documents like Police Verification Certificate, GST/EPF registration, and all documents required for MES enlistment.

**Special Provisions for Lower-Class Contractors:**

– If fewer than 7 eligible bidders are found after the initial technical scrutiny, contractors from **one class below** (Class ‘E’) the required class will also be considered.
– These lower-class contractors will be eligible if their residual work is not more than five times their tendering limit, **OR** if they can prove they meet the upgradation criteria (experience, turnover, solvency) for Class ‘D’.

### Important Instructions and Conditions

– **Submission of Physical Documents:** Bidders must upload scanned copies of the cost of tender documents and EMD (if applicable). The original physical copies must reach the Accepting Officer’s office within 5 days of the bid submission end date. Failure to do so can lead to disqualification or a ban from bidding.
– **No Subletting:** The work cannot be sublet to a third party. It must be executed by the bidding firm or its direct employees/family members as per the specified conditions.
– **Deficiency Rectification:** If any documents are missing, the bidder will be given a one-time opportunity of **7 days** to rectify the deficiency.
– **Right of Rejection:** The Accepting Officer reserves the right to reject any technical bid without assigning a reason. Rejected bidders can appeal to the Next Higher Engineer Authority (NHEA) before the price bid opening.
– **Revised BOQ:** If the Bill of Quantities (BOQ) is revised via a corrigendum, bidders must quote on the revised version. Quoting on the old version will be considered non-bonafide.
– **Related Firms:** Tenders will not be issued simultaneously to related firms (with common proprietors/partners/directors).
