## ⚙️ **Eligibility Criteria**

### **1. MES Enlisted Contractors**

* Must be **Class ‘A’ contractors** registered with MES under appropriate categories.
* Should not have any adverse remarks in workload or performance reports.
* Must have **MoU with solar power firms** rated **1A/1B/1C/2A/2B/2C** by accredited rating agencies (CRISIL, ICRA, CARE, FITCH, SMERA, Brickwork, etc.).
* Contractors with equivalent rating themselves may also qualify.

### **2. Non-MES (Un-enlisted) Contractors**

* Should meet MES “Class A” eligibility in terms of:

* Financial soundness, solvency, turnover, and working capital.
* Experience in Govt./PSU projects.
* Must have **valid MoU** with rated solar power companies.
* Should not be banned, suspended, or blacklisted by any government department.

### **3. Technical Qualification (PQC)**

* **Average annual turnover** in the last 3 years ≥ 30% of the estimated cost.
* **Experience:** Completed solar power projects for Govt./PSUs within 7 years:

* 3 similar works ≥ 40% of cost, or
* 2 similar works ≥ 50% of cost, or
* 1 similar work ≥ 80% of cost.

## 📄 **Bid Submission Details**

* All tender documents and bids must be submitted **online** via the Defence e-procurement system.
* Physical copies of **EMD and tender fee (DD/Banker’s cheque)** must reach within **7 days after bid closing**.
* Missing EMD/DD will lead to **bid rejection**.

### **Bid Opening**

* The **technical bid** is opened first.
* **Financial bids** of only technically qualified bidders are opened later.
* Dates are notified on the **defproc portal**.

## 📘 **Administrative Conditions**

* **Subletting:** Not permitted.
* **Court Jurisdiction:** Lies at the location of the tender issuing authority.
* **EPF registration** mandatory before award of contract.
* **Integrity Pact** to be signed by all bidders (Appendix ‘B’).
* Contractors one class below may be considered if fewer than 7 Class A contractors participate.

* **Purpose:** To promote ethical business practices and transparency in procurement.

* Collusion with competitors.
* Fraudulent behavior or coercion.
* **Consequences of violation:**

* EMD forfeiture.
* Contract termination.
* Debarment from future tenders.

## 🧩 **Joint Venture (Appendix ‘C’)**

* **Permitted:** Yes, with pre-bid registration of JV agreement.
* **Lead Partner:** Must meet **≥60%** of qualifying criteria.
* Combined JV must meet **120%** of overall eligibility norms.
* **Foreign JV partners not allowed**; Indian firms with foreign directors need security clearance.
* Only **one JV per bidder** allowed for a given tender.

* Standard format for **Performance Security (BG)** from Nationalized/Scheduled Bank.
* Must remain valid until completion of project and settlement of all dues.
