Summary:

**1. Parties Involved**
– **Petitioner:** TP Gopalpur Transmission Limited (TPGTL) (formerly known as ERES-XXXIX Power Transmission Limited).
– **Respondents:** Central Transmission Utility of India Limited (CTUIL) and Others.
– **Regulatory Body:** Central Electricity Regulatory Commission (CERC).

**2. Background & Procedural History**
– The Petitioner had previously filed two similar petitions (**Petition No. 513/TL/2024** for a license and **Petition No. 514/AT/2024** for tariff adoption) for the same project.
– In an order dated **December 18, 2025**, the Commission had **referred the proposal back to the National Committee on Transmission (NCT)** for reconsideration. The concern was the project’s “likely utilisation and impact on the consumers in the absence of any application for its use by the bulk consumers.” The Petitioner was given liberty to approach the Commission again after the NCT’s decision.
– Subsequently, Petition No. 514/AT/2024 was also disposed of on **January 7, 2026**, with a similar liberty granted to the Petitioner.

**3. Reconsideration by the National Committee on Transmission (NCT)**
– Following the Commission’s earlier direction, the NCT considered the matter in its **36th Meeting held on December 30, 2025**.
– The NCT provided a detailed reasoning on the criticality of the transmission project.
– The NCT **strongly recommended the early start of the project’s work**, upon the grant of the license by the Commission, emphasizing that the remaining time for completion was only about **24 months**.

**4. Current Petitions & Key Arguments**
The Petitioner filed two new petitions:
– **Petition No. 125/TL/2026:** Application for the grant of a transmission license under the CERC (Procedure, Terms and Conditions for Grant of Transmission License and other Related Matters) Regulation, 2024.
– **Petition No. 124/AT/2026:** Application under **Section 63 of the Electricity Act, 2003** seeking adoption of transmission charges discovered through a tariff-based competitive bidding process.

The Petitioner made the following key submissions:
– **Compliance with Procedural Requirements:** For the previously filed Petition No. 513/TL/2024, the Petitioner had already complied with all public notice and website publication requirements under the Transmission License Regulations (uploading Form I and Form II, and publishing Form II in newspapers).
– **Interlocutory Application (IA No. 34/2026):** Filed in Petition No. 125/TL/2026 seeking **exemption from re-complying** with these public notice and publication requirements for the new petition, since they had already been fulfilled for the earlier, related petition.
– **Service on Respondents:** Copies of the petitions had been served on the respondents, none of whom filed any reply.

**5. Commission’s Directions & Observations**
After hearing the counsel for the Petitioner, the Commission issued the following directions:

| Direction | Details |
| :— | :— |
| **Admission & Notice** | The petitions were admitted, and notice was issued to the respondents. |
| **Timeline for Submissions** | Respondents were directed to file their replies within **one week**. The Petitioner was allowed to file rejoinders within **three days** thereafter. |
| **Exemption Granted** | **IA No. 34/2026 was allowed.** The Petitioner was **exempted from re-complying** with the website uploading and newspaper publication requirements for Petition No. 125/TL/2026, as these had already been satisfactorily completed for the earlier Petition No. 513/TL/2024. |
| **Reservation of Order** | Subject to the above, the matters were **reserved for order**. |

**6. Status of the Project**
– **Project Name:** Eastern Region Expansion Scheme – XXXIX.
– **Development Model:** Tariff-Based Competitive Bidding (TBCB) process.
– **Criticality:** The NCT has strongly recommended early start, with a completion window of approximately **24 months** from the date of license grant.
– **Next Step:** Awaiting final order from CERC on the grant of the transmission license and adoption of transmission charges.
