**2. Eligibility Criteria for Bidders**

The tender is open to two categories of contractors, provided they meet specific criteria:

* **For MES Enlisted Contractors:**
* Must be enlisted in Class ‘D’ and above.
* Must have experience in Solar Power Projects as defined in the NIT.
* If they don’t have the required solar rating themselves, they must have an MoU with a CRISIL/CARE/etc. rated solar firm and meet the specified experience criteria.

* **For Contractors Not Enlisted with MES:**
* Must meet the enlistment criteria for MES ‘D’ Class (regarding turnover, solvency, and work experience).
* Must have an MoU with a rated solar power firm (CRISIL/CARE/etc.) with the requisite experience, or possess the rating themselves.
* Must submit detailed documents, including Police Verification, for security clearance. Foreign firms are not eligible.

* **General Eligibility for All:**
* Must have experience in successfully completing Solar Power Projects for Government/PSUs in the last seven years. The experience must meet one of these thresholds:
* One work of at least 80% of the NIT’s capacity.
* Two works of at least 50% of the NIT’s capacity.
* Three works of at least 40% of the NIT’s capacity.
* Must not be suspended, debarred, or blacklisted by any government body.

**3. Bidding Process and Key Requirements**

* **Platform:** E-tendering on `www.defproc.gov.in`.
* **Bid Structure:** Two-part bid system.
* **Cover-1 (Technical Bid):** Contains scanned copies of the DD for tender cost, EMD instrument, enlistment details, and all other eligibility documents.
* **Cover-2 (Financial Bid):** Contains the quoted rates (BOQ).
* **Document Acknowledgment:** Bidders are deemed to have full knowledge of the site conditions, contract documents (IAFW-1779, IAFW-2249, MES Schedule), and all terms, whether they have inspected them or not.

**4. Special Provisions and Conditions**

* **Relaxation for Remote Areas:** Since Pokaran is declared a remote/difficult area, contractors one or two classes below the eligible class may also bid, subject to certain conditions regarding work in hand and financial strength.
* **Related Firms:** Bids from related firms (with common Proprietors/Partners/Directors) will not be allowed simultaneously. A father and son with business dealings cannot bid for the same contract.
* **Physical Document Submission:** Even though bids are uploaded online, the original physical copies of the tender cost DD and EMD must reach the Accepting Officer’s office within 7 days of the bid submission end date. Failure to do so can lead to the financial bid not being opened or a ban from future bidding.
* **Deficiency Rectification:** If any document is missing in Cover-1, the contractor gets a one-time opportunity of 7 days to rectify the deficiency. Failure to do so will result in the financial bid (Cover-2) not being opened.
* **Right to Reject:** The Accepting Officer reserves the right to reject any or all bids without assigning a reason and is not bound to accept the lowest bid. Price preference may be given to Public Undertakings/SMEs as per government policy.
* **Appeal Process:** If a technical bid is rejected, the bidder can appeal to the NHEA (Next Higher Executive Authority) before the scheduled opening of Cover-2.
* **Penalty for Withdrawal:** If the lowest bidder tries to revise rates or withdraws their offer after the financial bid is opened, their EMD will be forfeited. The next lowest bid will not be considered, and the work will be re-tendered.
* **Subletting:** Subletting the work to a third party is not allowed. The work must be executed by the bidding firm or through its immediate family/employees, provided they are not separately enlisted contractors.
