### Key Business Points for Bidders
#### 1. Eligibility Criteria
– **For Enlisted MES Contractors:** Must be enlisted in Class ‘D’ or above, with satisfactory performance records and no adverse remarks in the Work Load Report (WLR).
– **For Un-enlisted Contractors:** Must meet the full enlistment criteria for ‘D’ Class contractors as per the MES Manual of Contracts 2020. This includes requirements for past project value, annual turnover, bank solvency, and working capital.
– **Technical Staff:** Bidders must employ either:
– One Graduate Engineer with 2 years of experience, OR
– One Diploma Engineer with 4 years of experience.
– **General Disqualifications:** Firms that are suspended, debarred, or blacklisted by any government body are ineligible.
– **Related Firms:** Bidders with common Proprietors/Partners/Directors are considered “related firms.” They will not be issued tenders simultaneously, and the Accepting Officer’s decision on this matter is final.
#### 2. Financial Details
– **Cost of Tender Documents:** Rs. 500/-, to be submitted via DD or Banker’s Cheque in favor of the GE (West) Jabalpur.
– **Earnest Money Deposit (EMD):** Rs. 90,000/-, also in favor of the GE (West) Jabalpur.
– The EMD for a successful bidder can be converted into part of the Performance Security.
– For unsuccessful bidders, the EMD is refundable.
#### 3. Bid Submission Process (Two-Cover System on e-portal)
– **Cover-1 (Technical Bid):** Contains the scanned DD for the tender cost, EMD instrument, enlistment details, and all other eligibility documents (e.g., application letter, police verification, work details).
– **Cover-2 (Financial Bid):** Contains the priced Bill of Quantities (BOQ).
– **Physical Documents:** While scanned copies are uploaded, the original physical DD and EMD instruments must reach the Accepting Officer’s office within 5 days of the bid submission end date. Failure to do so can lead to the rejection of the financial bid or a ban from bidding for six months.
#### 4. Important Rules and Clauses
– **No Alterations:** Bids proposing any alterations to the stated conditions are liable for rejection.
– **Right to Reject:** The Accepting Officer is not bound to accept the lowest bid and reserves the right to reject any or all bids without assigning a reason.
– **Deficiency Rectification:** If documents are missing or deficient in Cover-1, the contractor gets a one-time opportunity of seven days to rectify the issue. Failure to do so will result in the financial bid (Cover-2) not being opened.
– **Price Preference:** Public Sector Undertakings (PSUs) and Small & Medium Enterprises (SMEs) may be given preference, even if their bids are not the lowest, as per government policy.
– **Withdrawal/Revision of Bid:** Revoking an offer or revising rates upward after the financial bid is opened is considered a “willful default.” This leads to the forfeiture of the EMD (for un-enlisted contractors) or a suspension from tendering until an equivalent amount is deposited (for enlisted contractors).
– **Revised BOQ:** If the BOQ is revised via a corrigendum, bidders must quote on the latest version. Quoting on an older version renders the bid non-bonafide and will not be considered for the award.
#### 5. Appeals Process
If a bidder’s Technical bid is rejected, they have the right to appeal to the Next Higher Engineer Authority (NHEA) via email before the scheduled opening of Cover-2. The NHEA must decide within seven working days, and their decision is final and binding.
