**4. Eligibility Criteria**
**A. For MES Enlisted Contractors**
– Must be enlisted with MES in **Class ‘D’ or above** and category **”b (i)”**
– Satisfactory performance remarks in Work Load Return (WLR)
– One class below (or two for remote areas) may also be considered if conditions are met
**B. For Non-MES Enlisted Contractors**
– Must meet enlistment criteria for **Class ‘D’ & “b (i)”** as per MES Manual on Contracts 2020 (Para 1.4 & 1.5)
– Must not be suspended/debarred/blacklisted by any Govt./PSU
– Must submit:
– Police Verification/Clearance Certificate
– Proof of similar works completed with Central/State Govt/PSUs
– Annual turnover, bank solvency, working capital details
– Foreign firms **not eligible**
– Indian firms with foreign nationals as directors subject to **security clearance**

**6. Important Conditions & Clauses**
**A. Physical Document Submission**
– Scanned copies of DD/EMD must be uploaded in Cover 1
– **Physical copies** must reach GE (A) Jaisalmer within **7 days** of bid submission end date
– Failure leads to:
– MES enlisted: **6-month ban** from bidding
– Unenlisted: Financial bid not opened; **6-month circulation**
**B. Deficiency Rectification**
– If any document missing, contractor gets **7 days** from communication to rectify
– Non-compliance → financial bid not opened
**C. Subletting / Power of Attorney**
– Subletting to third party **prohibited**
– Work may be executed through POA to **son/daughter/spouse** of proprietor/partner/director or firm’s own employees, provided they are **not separately enlisted** with MES
**D. Revoking / Revising Offer**
– Revising rates upward or downward after opening of Cover 2 = **willful default**
– Penalty = **Forfeiture of EMD** (unenlisted) or **deposit of equivalent amount** (MES enlisted)
– Defaulting firm **ineligible** for re-tender
**E. Related Firms**
– Firms with common Proprietor/Partners/Directors treated as **related**
– Accepting Officer may issue tender to only **one** such firm

**F. Lowest Bidder Determination**
