## **Key Business & Eligibility Points**

### 1. **Eligible Bidders**
– **MES enlisted contractors** – Class “D” and any category, with a **Memorandum of Understanding (MoU)** with an eligible solar power firm.
– **Non-MES contractors** – Must meet MES ‘D’ Class enlistment criteria (work experience, turnover, solvency, working capital) and also have an MoU with a solar firm.
– **Solar firms** – Can bid directly **or** via MoU with a contractor, but **not both** in the same tender.

### 2. **Pre-Qualification Criteria (PQC) – Similar Work Experience (last 7 years)**
– **Three** similar works ≥40% of NIT capacity, **OR**
– **Two** similar works ≥50% of NIT capacity, **OR**
– **One** similar work ≥80% of NIT capacity.
– **“Similar work”** means: Design, supply, installation, testing & commissioning of solar power plants including electrical works, successfully completed in MES / Central/State Govt / PSU.
– **Mandatory:** Upload work orders, completion certificates, and performance reports.

### 3. **MoU Conditions**
– Only **one solar firm + one contractor** per MoU for this tender.
– Violation → bid invalid.

### 4. **Class Relaxation**
– If <7 eligible bidders, contractors **one class below** (or two classes below for remote areas) may be considered.
– **Exception:** If residual work >5 times tendering limit, they are **not** considered – unless they meet upgrade criteria (experience & financials).

### 5. **Foreign Firms** – Not eligible. Indian firms with foreign nationals as directors require security clearance.

## **Financial & Security Requirements**

– **Tender Cost:** ₹500 via DD/Banker’s Cheque in favor of *GE Nasik Road Camp*, payable at Nashik.
– **Performance Security:** 5% of contract value within 28 days of acceptance – via Bank Guarantee (Nationalized/Scheduled Indian bank), Govt securities, or FDR.
– **EMD (Earnest Money Deposit):** Required; forfeited if conditions breached.
– **Failure to provide Performance Security** → award cancellation & EMD forfeiture.

## **Submission & Compliance Rules**

– **Bidding portal:** https://defproc.gov.in
– **Bids:** Two covers – Technical (Cover I) and Financial (Cover II).
– **Scanned DD + enlistment docs** to be uploaded in Cover I.
– **Physical DDs & EMD instruments** must reach Accepting Officer within **5 days after bid submission end date**.
– If delayed: penalties include **6-month ban** from bidding.
– **No subletting** allowed. Work can be executed via power of attorney only to specified close relatives or firm employees (provided they don’t have their own MES enlisted firm).

## **Related Firms & Conflict of Interest**

– Tender not issued simultaneously to **related firms** (common proprietor/partners/directors).
– Father-son or close business relations cannot bid as separate competitors – both bids rejected.
– **Adjoining command enlistment not applicable** – only parent command index recognized.

## **Accepting Officer Authority**

– **Office:** Commander Works Engineer, Deolali.
– **Reserves right** to reject any bid without compensation.
– **Decision on related firms** is final and binding.
