## Eligibility Criteria
### A. For MES Enlisted Contractors
– Must have satisfactory performance in **Work Load Return (WLR)** or similar reports.
– Enlistment letter must be **duly renewed** for the current cycle.
### B. For Contractors NOT Enlisted with MES
Must meet Class ‘D’ & (i) category enlistment criteria, including:
– Satisfactory completion of requisite value of works with:
– Central/State Government
– Central/State PSUs
– AWHO / AFNHB / CGEWHO / DGMAP
– Minimum annual turnover
– Bank solvency
– Working capital requirements
– **No suspension / debarment / blacklisting** by any government authority
– If already working in MES, must have **no adverse remarks** in WLR
– If already secured **two MES works**, must get enlisted with MES, else ineligible

### For Un-enlisted Contractors
– Application on firm’s letterhead
– Scanned DD for tender cost + EMD
– Police verification report / Police Clearance Certificate / Character Certificate (or notarized passport copy of proprietor/partners/directors)
– **All documents required for MES enlistment** (as per Para 1.5, Section 1, MES Manual on Contracts 2020)
– Details of ongoing MES works (if any)
– EPF Registration / Code Number
– GST Registration
– Undertaking for **no ban or slow progress** in any government department
– Any other documents per Appendix

## 🔧 Important Business Rules & Clauses
### 1. Subletting Prohibited
– Work cannot be sublet or executed through POA to third party.
– **Allowed:** POA to sons/daughters/spouse of proprietor/partners/directors, or firm’s own employees/directors/project manager – **provided they do not have a separate enlisted MES firm in their name**.
### 2. Deficiency Rectification
– If documents are deficient, contractor gets **7 days** from communication to rectify.
– Failure → Financial bid not opened.
### 3. Right to Reject Technical Bid
– Accepting Officer can reject technical bid without any guarantee of opening financial bid.
– Appeal can be filed with **NHEA (HQ CE AF Allahabad)** within 7 days before scheduled financial bid opening.
– NHEA decision is **final and binding**.
### 4. Revised BOQ
– If BOQ is revised via corrigendum and bidder quotes on old BOQ → bid treated as **non-bona fide, wilful negligence**.
– Lowest tender determined from valid bids only.
### 5. Rate Revision / Offer Revocation After Opening
– Revoking offer or revising rates upward after Cover 2 opening = **wilful default**.
– Penalty = **amount equal to EMD**.
– Un-enlisted: EMD forfeited.
– Enlisted: Amount notified for deposit; tender evaluation suspended until deposited.
### 6. Related Firms
– Tender not issued simultaneously to **related firms** (common proprietor/partners/directors).
– Accepting Officer’s decision on which firm gets tender is **final**.
### 7. Jurisdiction
– **Only courts at the place of tender issuance (Agra)** have jurisdiction for disputes.

## 📊 Contractor Class Relaxation (Important for Smaller Contractors)
