Summary:

## **Key Decisions by the Commission**

### **1. Tariff Adoption (Approved)**
– The Commission **adopted the discovered tariffs** ranging from **₹3.35/kWh to ₹3.36/kWh** for the **1,200 MW** capacity.
– **Reasoning:** The tariffs are lower than previously adopted tariffs for similar hybrid projects (₹3.43–₹3.46/kWh in Petition Nos. 268/AT/2024 and 402/AT/2024), reflecting competitive market conditions.

### **2. Greenshoe Option – Not Exercised at This Stage**
– NTPC has **not yet awarded the additional 600 MW** under the Greenshoe Option due to lack of clear demand visibility from DISCOMs.
– The Commission granted **liberty to NTPC** to approach the Commission later for adoption of tariffs for Greenshoe capacity, if and when awarded.

### **3. Trading Margin**
– Approved trading margin of **₹0.07/kWh** for NTPC.
– **Condition:** If NTPC fails to provide escrow arrangement or an irrevocable, revolving Letter of Credit to generators, the margin is capped at **₹0.02/kWh** as per Trading Licence Regulations, 2020.

### **4. Delay in Filing – Condoned with Warning**
– The petition was filed beyond the **15-day timeline** prescribed under Clause 12.4 of the Hybrid Guidelines.
– The Commission **condoned the delay** but directed NTPC to strictly adhere to timelines in future cases.

### **5. Publication of Tender Notice – E-Publishing Approved**
– NTPC discontinued newspaper publication (Circular No. 763 dated 05.06.2018) and instead published on:
– NTPC’s tender website
– Central Public Procurement Portal (CPPP)
– Government e-Marketplace (GeM)
– The Commission accepted this as compliant with the Guidelines (which allow website publication as an alternative to newspapers).

### **6. Post-Adoption Compliance**
– NTPC must place on record copies of signed PPAs and PSAs once executed.
– If awarded capacity does not materialize into signed agreements, NTPC must inform the Commission.
