### **2. KEY DATES & FINANCIALS**

### **6. PERFORMANCE GUARANTEES**
– **Annual Generation Guarantee (NEEGG):** 36 lakh kWh/year with 0.7% annual degradation.
– **Performance Ratio (PR):** ≥80% at commissioning.
– **Compensation for Shortfall:** As per MPERC tariff rates.
– **Plant Uptime:** Fault rectification within 24 hours.

### **7. KEY CONTRACTUAL CONDITIONS**
– **Taxes:** All taxes (GST, labour cess, etc.) included in bid price.
– **Statutory Approvals:** Contractor’s responsibility (DISCOM, CEIG, MPERC, etc.).
– **Site Inspection:** Mandatory; no claim for ignorance of site conditions.
– **Labour & Safety:** Compliance with CPWD Safety Code, labour laws, ESI, EPF.
– **Insurances:** Contractor to insure works during construction and O&M.
– **Dispute Resolution:** Three-tier internal mechanism, then courts in Bhopal.
– **Governing Documents:** CPWD GCC-EPC 2024 with latest corrections.
