Q Cells files more patent infringement complaints in Germany, France
Solar products company Q Cells, which has dual headquarters in South Korea and Germany, has filed a patent infringement complaint in the Regional Court of Duesseldorf against rival Astronergy Solarmodule GmbH.
The photovoltaics (PV) maker has done so on March 12, according to an announcement. Furthermore, it has filed separate patent infringement complaints in France with the High Court of Paris a week later.
Q Cells pointed out in a news statement that this move follows a ruling by the same German court in mid-June 2020 that a trio of competitors had infringed the intellectual property (IP) rights of the firm.
The court concluded at the time that JinkoSolar GmbH, REC Solar EMEA GmbH and LONGi Solar Technologie GmbH had each unlawfully incorporated a patented technology of Q Cells into their own solar products.
According to the latest announcement, the defendants are awaiting the hearing in the appeal proceedings at the Duesseldorf Higher Regional Court, which is scheduled for April. Meanwhile, the European Patent Office is expected to rule this month on opposition proceedings launched against the particular patent.
The company stated that the additional legal actions reflect the company’s “strong willingness” to protect its technological innovations. “Q Cells will not tolerate any infringement of its intellectual property rights, and will take all possible pathways to stop any potential infringing activities,” it stressed.
