## 🏗️ **Scope of Work**

## 🧾 **Eligibility Criteria**
### **1. MES Enlisted Contractors with MoU**
* Must be **Class “D”** or higher MES registered contractors.
* Must hold a valid **MoU with a solar power firm** rated 1A/1B/1C/2A/2B/2C by CRISIL, CARE, ICRA, FITCH, SMERA, or Brickwork.
* Should not have adverse remarks in workload or performance reports.
### **2. Non-MES (Unenlisted) Contractors with MoU**
* Must meet Class “D” eligibility standards in financial solvency, turnover, and experience (as per MES Manual of Contracts 2020).
* Should not be debarred or blacklisted by any Govt. department or PSU.
* Must have a valid MoU with a qualified solar power firm.
### **3. Enlisted/Unenlisted Contractors without MoU**
* Must satisfy pre-qualification criteria (PQC) and can participate only if partnered with eligible solar firms.
### **4. Solar Power Firms Bidding Directly**
* Must meet PQC and possess valid credit ratings (1A to 2C).

## 🧠 **Pre-Qualification Criteria (PQC)**
**Experience Requirement (within the last 7 years):**
* 3 similar works ≥ 40% of capacity (i.e., ≥ 28 kW each), **or**
* 2 similar works ≥ 50% of capacity (≥ 35 kW each), **or**
* 1 similar work ≥ 80% of capacity (≥ 56 kW).
**Definition of “Similar Work”:**
Design, supply, installation, testing, and commissioning of solar power plants (with electrical integration) executed for MES, Central/State Government, or PSUs.
**Documents Required:**
* Work orders, completion certificates, performance reports verified by the concerned department.

## 🧩 **Additional Tender Conditions**
1. **Joint Participation Rules:**
* A solar firm may bid directly or through an MoU with an MES contractor (but not both).
* One MoU can exist only between one solar firm and one contractor.
2. **Class Relaxation Clause:**
* If fewer than **7 eligible bids** are received, one class lower MES contractors may be considered (if they meet experience and financial soundness criteria).
3. **Foreign Participation:**
* **Foreign firms not eligible.**
* Indian firms with foreign directors allowed subject to **security clearance.**
4. **No Subletting:**
* Work cannot be sub-contracted to third parties except to close relatives (spouse, son/daughter) or employees of the firm.
5. **Performance Security:**
* Within **28 days of LOA**, contractor must furnish a **5% Performance Security** (via Bank Guarantee or Govt. Security).
6. **Documents Required (MES Enlisted Contractors):**
* Application on firm letterhead
* Enlistment certificate (renewed)
* Tender fee and EMD proof
* Other eligibility documents per Appendix A
7. **Documents Required (Unenlisted Contractors):**
* Application and police verification
* Tender fee and EMD proof
* Financials, solvency, and project experience certificates
* Passport copies for key personnel
8. **Physical Submission of DD/EMD:**
* Must reach the accepting office within **5 days** of bid closing.
* Failure to comply results in **6-month ban** from MES tenders.

## ⚖️ **General Conditions**
* Bidders must familiarize themselves with **local site conditions** before submission.
* **Alterations or conditional bids** will be rejected.
* Uploading a bid implies full knowledge of contract clauses and local factors.
* The **Accepting Officer** may reject any bid without assigning reason and is not bound to accept the lowest.
* Jurisdiction for disputes: **Court of tender issuance location.**
* The NIT and Appendix ‘A’ form part of the tender document.
