**3. Eligibility Criteria for Bidders:**
* **Primary Eligibility:**
* **MES Enlisted Contractors:** Must be enlisted in **Class ‘E’ or above**, under category **b(i) Low Tension Electric Works (Excluding 33KV)**. Must possess a Provident Fund Code Number and GST Registration. Satisfactory Work Load Return (WLR) is required.
* **Non-Enlisted Contractors:** Must meet the enlistment criteria for MES Class ‘E’ in categories **b(i) Low Tension Electric Works (up to 1100V) and b(ii) High Tension Electric Works (Excluding 33KV)**. Criteria include proven experience with Government/PSUs, specified annual turnover, bank solvency, working capital, and no history of suspension/debarment.
* **Special Provisions & Class Relaxation:**
* If fewer than 7 eligible bids are received, MES contractors **one or two classes below** the eligible class may be considered, subject to workload limits (residual work ≤ 5x tendering limit).
* Contractors below the eligible class can bypass the workload limit if they provide documentation proving they meet the **up-gradation criteria** (based on past work experience, turnover, and financial soundness) to the stipulated class.
* Foreign firms are **not eligible**. Indian firms with foreign directors require security clearance.
* **Related firms** (with common proprietors/partners/directors) cannot bid simultaneously for the same tender.
**4. Financial Guarantees:**
* **Earnest Money Deposit (EMD):** INR 49,500 in the form of a **”Deposit at Call Receipt”** (FDR not acceptable) in favor of GE (Army) Baroda.
**5. Bid Submission & Evaluation Process:**

* **Technical Evaluation:** The Accepting Officer (Commander Works Engineer, Nagpur) has absolute discretion to validate or reject Technical Bids. Rejection reasons will be in the evaluation report on the website.
* **Appeal Process:** Rejected bidders can appeal via email to the Next Higher Engineer Authority (Headquarter Chief Engineer Bhopal Zone) before the Cover-2 opening date. The NHEA’s decision within 7 working days is final.
* **Award & Post-Award:** The Accepting Officer is not bound to accept the lowest bid. **Revoking or revising rates upward after financial bid opening is a willful default**, attracting a penalty equal to the EMD, forfeiture of eligibility for this tender’s reissue, and suspension from future tenders.
